By accessing or using the Pay Hero website, mobile application, or any other services provided by Pay Hero (collectively, the “Services”), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Services.
2. Eligibility
You must be at least 18 years old to use our Services. By using the Services, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all of these Terms of Use.
3. Account Registration
- To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
- You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party.

- You agree to use the Services only for lawful purposes and in accordance with these Terms of Use.
- You agree not to use the Services:
- In any way that violates any applicable federal, state, local, or international law or regulation

- To impersonate or attempt to impersonate Pay Hero, a Pay Hero employee, another user, or any other person or entity
- To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or which, as determined by us, may harm Pay Hero or users of the Services or expose them to liability
5. Intellectual Property Rights
- The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Pay Hero, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
- These Terms of Use permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services.
6. User Content
- The Services may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“User Content”). You are responsible for the User Content that you post on or through the Services, including its legality, reliability, and appropriateness.
- By posting User Content on or through the Services, you grant Pay Hero the right to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Services.
7. Payment Terms
- Certain aspects of the Services may be provided for a fee. You agree to pay all fees associated with the Services you use.
- You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services.
- We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order, or other reasons.

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms of Use.

In no event shall Pay Hero, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.
10. Disclaimer
Your use of the Services is at your sole risk. The Services are provided on an “AS IS” and “AS AVAILABLE” basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
